These conditions apply to all sales made from this site, to the exclusion of all other conditions, in particular those in force for sales in Podexpert shops.

Changes to these General Terms and Conditions of Sale are enforceable against users of the site from the time they are put online and cannot be applied to transactions concluded previously.


The present conditions are intended for a consumer who has full legal capacity. These conditions apply to all orders that you place on the www.podexpert.com website.


We do our utmost to satisfy you. On this site, we present all the essential characteristics of the shoes and accessories sold. We will be attentive to any comments you may make.


2. General conditions of use

On the Internet: www.podexpert.com.

The site is accessible free of charge to anyone with Internet access.

The user of www.podexpert.com is responsible for his or her own computer equipment and Internet access.

All costs relating to access to www.podexpert.com shall be borne by the user.


The administrators of the site www.podexpert.com will do everything in their power to ensure 24/7 access to www.podexpert.com but cannot be held responsible for any problem or malfunction that would prevent access to the site. 


2.1 Customer account

To place an order, the user must create a customer account.

The creation of an account on the site is reserved for any natural person aged at least 18 years and who has full legal capacity. Each user can only create one account.


All the fields in the account creation form must be filled in, with the exception of those indicated as optional. Failure to do so will result in the account not being created. All information provided must be accurate.

The user may choose whether or not to receive the newsletter by e-mail by clicking on the box "I wish to receive exclusive promotions and discounts from podexpert by e-mail.


The identified user may, at any time, unsubscribe from the newsletter by clicking on the link provided for this purpose at the bottom of each newsletter. It is also possible to unsubscribe by going to your customer account and clicking on "Manage your subscriptions to our news and promotional emails".


2.2 Ordering

You make your selection by browsing the pages of our site. Your selections, together with the associated options, are added to your basket when you click on "Add to basket". At any time while browsing our site, you can view your order by clicking on "My purchases".


2.3 Contract validation

When you click on "My purchases", a confirmation message appears. It summarises all the products and options selected.

To validate your choice, click on "Complete my order" or on "Continue shopping" if you wish to add items to your basket.


You must then choose your method of payment and delivery.
You must check in this order form all the information transmitted, and in particular all the elements useful for the delivery (delivery address, digicode, telephones...)
If you do not have to modify the form, you must then read the present conditions. If you accept them, you must tick the box "I have read and accept the general terms of sale".
To continue with your order, click on "Complete my order".


When you click on "Complete my order", you will have a summary of your order with the billing and delivery addresses, the selected items and associated options, the delivery method and the payment method.

To continue your order, click on "Confirm my order with payment obligation".

Your order is then validated.

After payment on our secure server (See ''Payment''), an acknowledgement of receipt is displayed. It confirms the registration of your order and informs you that a confirmation e-mail will be sent to you as soon as possible.


2.4 Technical means of identification and correction of errors

You have the right to identify and correct any errors made when entering your data at any time. If you become aware of an error after the conclusion of the contract, you must contact us (click here to access the "contact us" section)


2.5 Archiving and contract access arrangements

We will archive contracts, order forms and invoices on a reliable and durable medium.
You have the right to access these documents for orders of 120 € or more.


2.6 Cookies

Podexpert.com has recourse to the use of cookies in order to recognise the client when he/she connects to the site. The user may at any time deactivate the use of these cookies by selecting the appropriate settings in his browser. However, this deactivation will prevent access to certain features of the site.


3. Legal and contractual guarantees

3.1 Legal guarantees

In accordance with the legal provisions in force relating to the conformity of the goods to the contract, in matters of hidden defects (available in appendix 1 of the present conditions), we will reimburse you, repair or exchange any product which appears to be defective, damaged or does not correspond to your order.
We will also reimburse you for the full cost of returning the product to us upon presentation of the relevant receipts.
We are at your disposal on 02 57 52 04 13 (price of a national call), from Monday to Friday from 9am to 12pm and from 2pm to 6pm, for any question relating to the return of a product purchased on the www.podexpert.com website.
The exchange or reimbursement of the product, as well as the return costs on proof, can only be made if the product is returned in its original packaging, including all the original parts.
When your product is delivered, Podexpert.com strongly advises you to check the condition of the parcel delivered by La Poste or another carrier.


3.2 Contractual guarantees

Products purchased on www.podexpert.com may be covered by a contractual guarantee. Different contractual guarantees are offered on the product page. To subscribe to these guarantees, you must add them to your basket.

You must keep your purchase invoice in order to benefit from your contractual guarantee.
In the event of abnormal use or wear and tear of the product, no contractual guarantee can be applied to the product.


3.3 Liability

We do our best to satisfy you. We are responsible for the proper execution of these general conditions. However, we shall not be liable for any unforeseeable circumstances, force majeure, unforeseeable and insurmountable act of a third party to the contract or for the non-conformity of the product with foreign legislation in the event of delivery in a country other than France.
We cannot be held responsible for misuse of the product, or inappropriate use of the product


4. Delivery times, costs and methods

4.1 Delivery terms

We will deliver the products to the address indicated in the order form.
When you place your order, you will be offered three delivery methods:

  • delivery to a Colissimo collection point (France and Belgium)
  • delivery in Colissimo followed by La Poste (France and the rest of the world)
  • delivery by Chronopost - Chrono 13 (France)
  • delivery by Lettre Suivi by La Poste (Metropolitan France)

In the case of a mail order, only delivery by Colissimo is offered. You cannot take advantage of free delivery at a Colissimo collection point. 


4.2 Delivery time

We will deliver your order at the latest on the date indicated in the order confirmation message (subject to payment validation).

In the event of a delay in delivery, we will inform you by e-mail as soon as possible and we will propose a new date.
If the products purchased on the www.podexpert.com website are not delivered within seven days of the date specified at the time of the order, and if this delay is not due to an event of force majeure, the customer may request the cancellation of the sale by sending a letter with acknowledgement of receipt to Podexpert, 18 rue de la Villeneuve, 29200 Brest. The sums paid by the client will be refunded directly to him/her within a period of less than 30 days. The client has a period of sixty working days from the date of dispatch to request the cancellation of the sale on the grounds that the goods have not been delivered within the contractual period.

Delivery times vary according to the delivery method chosen by the customer when ordering:

  • Colissimo Domicile or Point Retrait: Metropolitan France: 2 working days from dispatch.
  • Colissimo Domicile: Dom Tom: 5 to 8 working days from dispatch.
  • Colissimo Domicile or Point Retrait: Europe: 3 to 8 working days from dispatch.
  • Colissimo Domicile: International: 4 to 8 working days from dispatch.
  • Chronopost: 1 working day from dispatch.
  • Lettre Suivi: 2 to 5 working days from dispatch.

4.3 Delivery costs

Delivery costs depend on the delivery method chosen by the customer when ordering on the www.podexpert.com website:

  • Colissimo Point Retrait: Metropolitan France: Free delivery for any purchase of a pair of shoes.
  • Colissimo Domicile : Metropolitan France : Service charged from 5,90 euros.
  • Colissimo Domicile: DOM TOM: Service charged from 16.80 euros.
  • Colissimo Domicile: Europe: Service charged from 7.20 euros.
  • Colissimo Domicile: International: Service charged from 20.70 euros.
  • Chronopost Chrono 13: Metropolitan France: Service charged from 25 euros.
  • Lettre Suivi: Metropolitan France: Service charged from 3 euros.

4.4 Delivery tracking

You can contact us by telephone for any question relating to your delivery, at 02 57 52 04 13 (price of a national call), from Monday to Friday from 9am to 12pm and from 2pm to 6pm.

5. The price

The prices of our products are indicated in euros including all taxes (French VAT and other applicable taxes) for individuals and in euros excluding taxes for professionals. They include the cost of processing your order.
If you request delivery outside of France, your order may be subject to possible taxes and customs duties when it reaches its destination.
The payment of these duties and taxes is your responsibility and we invite you to check with the relevant authorities in your country. You must also check the possibilities of importing or using the products you order from us in the country of destination.


6. Payment methods and means of security and withdrawal

6.1 Payment methods

You have several means of payment to pay for your purchases on www.podexpert.com:

  • By credit card: Visa, MasterCard, American Express, Carte bleue, or any other credit card issued in France. Payment by credit card is perfectly secure. Your order will be registered and validated as soon as the payment is accepted by the bank you have chosen.
  • By PayPal: your financial information is never communicated to Podexpert.com. Indeed, PayPal encrypts and protects your card number. Pay online by simply entering your email address and password.
  • By cheque: by sending us your cheque, issued by a bank domiciled in France, made out to Pod Expert, to the following address Podexpert, 18 Rue de la Villeneuve 29200 BREST. The ordered articles are then reserved 5 days as from the date of the order. After this period and in the absence of receipt of the corresponding cheque, Pod Expert reserves the right to cancel the customer's order. The cheque will then be returned to him upon receipt. The cashing is carried out with reception of the cheque.
  • By bank transfer: by making a transfer towards our account Podexpert (RIB provided after confirmation of your order).

The payment is validated when the cheque is credited on the account of Pod Expert in the event of payment by cheque and with reception of the complements of information requested in the event of payment by bank card requiring additional checks.


6.2 Satisfied or refunded: methods of exercising the right of retraction

In accordance with the legal provisions, within 14 days of receiving your product, you may exercise your right of withdrawal. You do not have to give any reason or pay any penalty. With the exception of the cost of returning the goods, which you must pay, we will refund the total amount paid within 30 days of your withdrawal. At our suggestion, you can also opt for another method of reimbursement.
This right of withdrawal also applies to products on sale.


6.3 Return policy

You can return your item(s) within 14 days from the day you receive your order.

Only a product exchange can benefit from free returns. In the case of a refund, the return costs are at your expense.

The free exchange can only be done through Colissimo Point Retrait and only in metropolitan France.
The free exchange does not concern promotional items.

For hygiene reasons, socks and silicone foot protection items are neither returned nor exchanged.
The returned item(s) must be new, unused and in their original, undamaged box.

In the case of an exchange or refund of "CHUT" shoes, all returns will be refused if the refund labels have been removed from their slots.
All exchanges or returns must be accompanied by a return request.

Log in to your customer account (By clicking here) then use the contact form (By clicking here) and choose the reason "Return" in the drop-down list and the order number corresponding to your request.

Fill in the return form that you will have to attach to your return.

Any return without this form will result in an additional delay for its treatment.
You can only make one return request per order on the www.podexpert.com website.
Once the return has been validated by Podexpert, you will receive a label (in the case of an exchange) that you must attach to your parcel and drop it off at the Colissimo collection point of your choice.
If you want the same item in another size/colour, an exchange will be made.

If you want a different item, you will have to place a new order and the returned item(s) will be refunded as soon as they are back in stock.

If you return items by a method of transport not validated by Podexpert, you will incur return costs and will not be entitled to any refund from Podexpert.


7. Duration of the contract and validity of the price

Prices include the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the products on sale on Podexpert.com .
The products remain the sole property of Podexpert.com until full payment has been received by Podexpert.com.
Our price offers are only valid within the double limit of the validity period of the offer concerned and the stocks available.
Our offers of goods and prices are valid if they appear online on the site on the day of the order.


8. Applicable law / Jurisdiction

The present conditions are subject to French law.
In the event of a dispute over the form or content of the order, the French courts shall have exclusive jurisdiction.

10. Personal information

We collect your personal information for the management of your orders and the follow-up of our commercial relations. It may be passed on to our partners exclusively for the execution of your orders, in accordance with the present general conditions
In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, delete, rectify and oppose any personal data concerning you. All you have to do is write to us online at Customer Service or by post to Podexpert, 18 rue de la Villeneuve, 29200 Brest, giving us your surname, first name, e-mail address, address and if possible your customer reference.


11. Annexes

Annexe 1 : Dispositions du Code de la consommation concernant la garantie légale de conformité

Article L211-4

Le vendeur est tenu de livrer un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance.
Il répond également des défauts de conformité résultant de l'emballage, des instructions de montage ou de l'installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.


Article L211-5

Pour être conforme au contrat, le bien doit :
1° Etre propre à l'usage habituellement attendu d'un bien semblable et, le cas échéant :
- correspondre à la description donnée par le vendeur et posséder les qualités que celui-ci a présentées à l'acheteur sous forme d'échantillon ou de modèle ;
- présenter les qualités qu'un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l'étiquetage ;
2° Ou présenter les caractéristiques définies d'un commun accord par les parties ou être propre à tout usage spécial recherché par l'acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.


Article L211-6

Le vendeur n'est pas tenu par les déclarations publiques du producteur ou de son représentant s'il est établi qu'il ne les connaissait pas et n'était légitimement pas en mesure de les connaître.


Article L211-7

Les défauts de conformité qui apparaissent dans un délai de six mois à partir de la délivrance du bien sont présumés exister au moment de la délivrance, sauf preuve contraire.
Le vendeur peut combattre cette présomption si celle-ci n'est pas compatible avec la nature du bien ou le défaut de conformité invoqué.


Article L211-8

L'acheteur est en droit d'exiger la conformité du bien au contrat. Il ne peut cependant contester la conformité en invoquant un défaut qu'il connaissait ou ne pouvait ignorer lorsqu'il a contracté. Il en va de même lorsque le défaut a son origine dans les matériaux qu'il a lui-même fournis.


Article L211-9

En cas de défaut de conformité, l'acheteur choisit entre la réparation et le remplacement du bien.
Toutefois, le vendeur peut ne pas procéder selon le choix de l'acheteur si ce choix entraîne un coût manifestement disproportionné au regard de l'autre modalité, compte tenu de la valeur du bien ou de l'importance du défaut. Il est alors tenu de procéder, sauf impossibilité, selon la modalité non choisie par l'acheteur.


Article L211-10

Si la réparation et le remplacement du bien sont impossibles, l'acheteur peut rendre le bien et se faire restituer le prix ou garder le bien et se faire rendre une partie du prix.
La même faculté lui est ouverte :
1° Si la solution demandée, proposée ou convenue en application de l'article L. 211-9 ne peut être mise en oeuvre dans le délai d'un mois suivant la réclamation de l'acheteur ;
2° Ou si cette solution ne peut l'être sans inconvénient majeur pour celui-ci compte tenu de la nature du bien et de l'usage qu'il recherche.
La résolution de la vente ne peut toutefois être prononcée si le défaut de conformité est mineur.


Article L211-11

L'application des dispositions des articles L. 211-9 et L. 211-10 a lieu sans aucun frais pour l'acheteur.
Ces mêmes dispositions ne font pas obstacle à l'allocation de dommages et intérêts.


Article L211-12

L'action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.


Article L211-13

Les dispositions de la présente section ne privent pas l'acheteur du droit d'exercer l'action résultant des vices rédhibitoires telle qu'elle résulte des articles 1641 à 1649 du code civil ou toute autre action de nature contractuelle ou extracontractuelle qui lui est reconnue par la loi.


Article L211-14

L'action récursoire peut être exercée par le vendeur final à l'encontre des vendeurs ou intermédiaires successifs et du producteur du bien meuble corporel, selon les principes du code civil.


Annexe 2 : Dispositions du Code civil concernant la garantie contre les vices cachés

Article 1641

Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les

avait connus.


Article 1642

Le vendeur n'est pas tenu des vices apparents et dont l'acheteur a pu se convaincre lui-même.


Article 1642-1

Le vendeur d'un immeuble à construire ne peut être déchargé, ni avant la réception des travaux, ni avant l'expiration d'un délai d'un mois après la prise de possession par l'acquéreur, des vices de construction ou des défauts de conformité alors apparents.
Il n'y aura pas lieu à résolution du contrat ou à diminution du prix si le vendeur s'oblige à réparer.


Article 1643

Il est tenu des vices cachés, quand même il ne les aurait pas connus, à moins que, dans ce cas, il n'ait stipulé qu'il ne sera obligé à aucune garantie.


Article 1644

Dans le cas des articles 1641 et 1643, l'acheteur a le choix de rendre la chose et de se faire restituer le prix, ou de garder la chose et de se faire rendre une partie du prix, telle qu'elle sera arbitrée par experts.


Article 1645

Si le vendeur connaissait les vices de la chose, il est tenu, outre la restitution du prix qu'il en a reçu, de tous les dommages et intérêts envers l'acheteur.


Article 1646

Si le vendeur ignorait les vices de la chose, il ne sera tenu qu'à la restitution du prix, et à rembourser à l'acquéreur les frais occasionnés par la vente.


Article 1646-1

Le vendeur d'un immeuble à construire est tenu, à compter de la réception des travaux, des obligations dont les architectes, entrepreneurs et autres personnes liées au maître de l'ouvrage par un contrat de louage d'ouvrage sont eux-mêmes tenus en application des articles 1792, 1792-1, 1792-2 et 1792-3 du présent code.
Ces garanties bénéficient aux propriétaires successifs de l'immeuble.
Il n'y aura pas lieu à résolution de la vente ou à diminution du prix si le vendeur s'oblige à réparer les dommages définis aux articles 1792, 1792-1 et 1792-2 du présent code et à assumer la garantie prévue à l'article 1792-3.


Article 1647

Si la chose qui avait des vices a péri par suite de sa mauvaise qualité, la perte est pour le vendeur, qui sera tenu envers l'acheteur à la restitution du prix et aux autres dédommagements expliqués dans les deux articles précédents.
Mais la perte arrivée par cas fortuit sera pour le compte de l'acheteur.


Article 1648

L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice.
Dans le cas prévu par l'article 1642-1, l'action doit être introduite, à peine de forclusion, dans l'année qui suit la date à laquelle le vendeur peut être déchargé des vices ou des défauts de conformité apparents.


Article 1649

Elle n'a pas lieu dans les ventes faites par autorité de justice.
